These Terms & Conditions ("Terms") are a binding agreement between you and Ferrell's Air Conditioning & Heating ("Ferrell's Air Conditioning & Heating," "we," "us," or "our") governing your access to and use of our website and the services we provide. You must be at least 18 years old and able to form a binding contract to use our website or request services. By using the site, you represent that you meet these requirements and that any information you provide is accurate.

2. Our Services

Ferrell's Air Conditioning & Heating provides residential and light-commercial heating, cooling, heat-pump, ductless, indoor-air-quality, and related HVAC services in Shelbyville, KY and the surrounding service area. Services are subject to availability, site conditions, and our assessment, and we may decline or discontinue service at our discretion.

3. AI & Automated Content

Portions of our website content may be created or assisted by artificial intelligence, and we may offer automated features such as chat assistants or estimating tools. These tools are provided for general information and convenience, operate with human oversight, and may be incomplete, out of date, or inaccurate. 4. Estimates & Quotes

5. No Professional Advice

6. Scheduling & Cancellation

  • Appointments are scheduled based on availability; we make every effort to arrive within the scheduled window.
  • Please give us at least 24 hours’ notice to cancel or reschedule when possible.
  • Missed appointments without notice may be subject to a service-call or trip fee.
  • Appointments outside published office hours are not guaranteed.

7. Pricing, Payment & Financing

  • We provide pricing before work begins; the price may be adjusted if additional work or parts are discovered, after we communicate the change.
  • Unless otherwise agreed in writing, payment is due upon completion of services.
  • We accept major credit cards, checks, and approved financing.
  • Financing, when offered, is provided by a third-party lender and is subject to that lender’s terms, rates, and approval. We do not process credit-card payments through this website.

8. Workmanship & Manufacturer Warranties

We stand behind our work with the labor and parts warranties stated in your service agreement, and manufacturer warranties may apply to installed equipment. Warranty terms and duration vary by service and equipment and are provided at the time of service. Warranties do not cover damage from misuse, neglect, lack of required maintenance, alterations or repairs by others, power or environmental events, or pre-existing conditions. Except for these express warranties, all other warranties are disclaimed as stated in Section 11.

9. Intellectual Property & Limited License

All content on our website — text, graphics, logos, images, and trademarks — is owned by Ferrell's Air Conditioning & Heating or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive license to view the site for your personal, non-commercial use. You may not copy, reproduce, scrape, or create derivative works from our content without our written permission.

You agree to defend, indemnify, and hold harmless Ferrell's Air Conditioning & Heating and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the website, or your violation of any law or the rights of a third party.

14. Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, you agree that any dispute will be brought exclusively in the state or federal courts located in or serving Shelby County, Kentucky, and you consent to their jurisdiction.

15. Dispute Resolution, Arbitration & Class-Action Waiver

Informal resolution first. Before starting an arbitration or lawsuit, you agree to contact us at [email protected] and give us 30 days to resolve the issue informally.

Binding arbitration. Except for the carve-outs below, any dispute arising out of or relating to these Terms, the website, or our services will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in or serving Shelby County, Kentucky, rather than in court. The arbitrator decides all issues, except that a court may decide the enforceability of this provision.

Class-action waiver. Disputes will be brought only in your or our individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Carve-outs. Either party may bring a qualifying claim in small-claims court and may seek injunctive relief in court to protect intellectual-property or confidential-information rights.

30-day opt-out. You may opt out of this arbitration and class-waiver provision by sending written notice with your name and contact information to 6036 Frankfort Rd, Shelbyville, KY 40065, or to [email protected], within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.

16. Third-Party Services & Links

Our website may include or link to third-party services (such as financing, analytics, maps, and review platforms). We are not responsible for third-party content, products, or practices, and your use of them is at your own risk and subject to their terms.

17. Termination

We may suspend or terminate your access to the website at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 9–15) will survive.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the website or services after changes take effect means you accept the updated Terms.

19. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and any signed service agreement, are the entire agreement between you and Ferrell's Air Conditioning & Heating regarding the website and services.
